Burgess set for first appearance following fed indictment

A Roanoke Rapids man is scheduled for a first appearance this morning in Greenville after his indictment last week on a federal weapon possession charge.

Clarence Lee Burgess Jr. will appear before Magistrate Judge Kimberly A. Swank at 10 a.m., federal court records show.
Burgess, who sources and documents in the public record confirm was the victim in a Roanoke Rapids hotel parking lot shooting in January, was indicted by a federal grand jury for one count of having a weapon and ammunition in his possession as a convicted felon in violation of United States Code.
A person has since been arrested in the hotel shooting.
Halifax County Sheriff Wes Tripp, in a statement released Tuesday evening, said the federal indictment stems from a shots fired call last October in the area of Highway 48 and Carolina Rest Home Road and a subsequent traffic stop.
Corporal Roger Jenkins encountered Burgess, 34, and a handgun fell from his pants leg.
Burgess was arrested and charged with carrying a concealed weapon and possession of firearm by felon.
The case was submitted to Task Force Officer Michael Newson with the Bureau of Alcohol, Tobacco, Firearms and Explosives for further investigation because of Burgess’s criminal history.
Burgess has an extensive record with state Department of Public Safety dating back to 2004.
Burgess was arrested Tuesday shortly before 2 p.m.at his residence by Jenkins and agents of the City County Drug Task Force.
The federal indictment against Burgess also includes a forfeiture notice on any firearm or ammunition involved in the offense.
